Terms and Conditions

Welcome to www.partyloomers.ca, operated by PartyLoomers (“PartyLoomers”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your use of our website and services, including the purchase, delivery, setup, and takedown of balloon décor and event backdrops. By using our site or placing an order, you agree to be bound by these Terms. If you do not agree, please refrain from using our site or services.

1. Services Provided

PartyLoomers offers custom balloon installations, backdrop rentals, and décor packages for events. Orders may be placed through our website or directly via email or social media. All services are subject to availability.
We reserve the right to refuse any order at our discretion and to terminate service provision without notice if Terms are violated.

2. Payment

• Deposit & Booking: A 50% non-refundable advance is due at the time of booking plus a $50 refundable damage deposit. Bookings are not confirmed until these payments are received.

• Balance: The remaining 50% is due on the day of the event after the decoration is completed.

• Damage Deposit: The $50 damage deposit will be refunded after takedown and inspection (which may occur later the same day or early the next day) if no damage or missing items are found. If damage or loss is identified, the deposit is not refunded and you remain responsible for any costs exceeding $50.

• We accept major credit cards and Interac e-transfers. Custom orders may incur additional fees based on design complexity, materials, or location.
  
  

3. Cancellations, Refunds, and Credits

We do not provide cancellations, refunds, or credits for any orders (including custom and standard packages). This is because materials are ordered immediately after booking to secure your event.
Nothing in this section limits any non-waivable rights you may have under applicable consumer laws.

4. Delivery and Setup

• Delivery Fee: Delivery is available within Metro Vancouver and is charged additionally based on location and distance from our base.

• Timing: Deliveries are made within a mutually agreed 1–2 hour window. We are not liable for delays caused by traffic, weather, or other conditions beyond our control.

• Access: You are responsible for ensuring venue access (parking/loading, elevator access, entry permissions). If access is denied or the site is unavailable, we may leave items or return them at our discretion; no refunds are provided.

• Setup/Takedown Fees: No additional charge for setup and takedown.
  
  

5. Outdoor Installations

Outdoor setups are subject to weather conditions. Direct sun, wind, heat, and rain can affect balloon integrity and stability. If outdoor conditions are unsafe or unsuitable, PartyLoomers may recommend an indoor alternative. No refunds are issued for weather-related damage after delivery/setup. We are not responsible for popping, oxidation, shrinkage, or reduced float/garland longevity due to heat, cold, or sun exposure.

6. Balloon and Décor Longevity

Latex balloons typically last 12–24 hours indoors and may oxidize (appear matte). Air-filled garlands/backdrops may last several days indoors depending on conditions. Outdoor longevity is not guaranteed.

7. Safety and Liability

• Choking Hazard: Balloons can pose a choking risk. Children under 8 must be supervised at all times. Keep balloons and small components away from pets and small children. Products are not for consumption.

• Venue Surfaces: Adhesives, command hooks, or mounting hardware may affect paint or finishes. You assume responsibility for venue approval and any resulting surface damage.

• After We Leave: We set up and leave the venue and typically return only for takedown after the event. From the moment setup is completed until we return for takedown, you are responsible for the care, supervision, and stability of the installation.

• No-Control Period: Because we are not present during your event and cannot control how the setup is handled, PartyLoomers is not liable for any injury, property damage, or other loss arising from the installation after we depart, including if a backdrop or décor falls or is moved/altered by anyone at the venue.

• Client Handling: Do not move, re-position, or attach additional items to our installations. If you or your venue staff move or alter the setup, you assume all risk; the damage deposit may be forfeited and additional charges may apply.

• Legal Cap: To the fullest extent permitted by law, our liability is limited as set out in Section 11 and does not extend to periods when we are not in control of the setup. This Section does not limit liability to the extent caused by our gross negligence or willful misconduct where such limitations are not permitted by law.
  
  

8. Setup and Takedown (Strike)

• Included: Standard setup and takedown are included at no additional charge.

• Takedown Timing: Takedown occurs later the same day or early the next day, as agreed in advance.

• Care Between Setup and Takedown: You are responsible for safeguarding the setup (including barriers or signage if needed) until we return.

• Surface/Access Risks: We are not responsible for damage to walls, paint, or surfaces where mounting is requested/required. Ensure adequate access for safe takedown.
  
  

9. Product Changes and Approvals

If a balloon color, décor element, or component becomes unavailable or a design/material change is necessary (including due to supply or safety considerations), we will communicate proposed changes in advance and obtain your approval before proceeding. Timely approvals are required to keep your event on schedule.

10. Intellectual Property

All content, images, and designs on www.partyloomers.ca and PartyLoomers social media are the property of PartyLoomers and may not be copied, reused, or modified without written consent.

11. Limitation of Liability

To the fullest extent permitted by law, PartyLoomers shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to our services or products, including delays, event disruptions, or property damage. In any event, our total aggregate liability shall not exceed the amount you paid for the specific order giving rise to the claim. Nothing herein limits liability that cannot be limited under applicable law.

12. Privacy

Your personal information is handled in accordance with our Privacy Policy. We do not sell your personal information.

13. Modifications to Terms

PartyLoomers may update these Terms at any time. Updated versions will be posted on our website with the effective date. Continued use of our services after the effective date constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada. Any disputes shall be resolved in the courts located in Vancouver, BC.
